Seminar summary

The legal Responsibility of Care-Givers to Look after Young Persons and Adults in the Family Unit. The Criminal Code typically makes it an offence when certain acts are committed that violate societal norms. However, in limited circumstances, the failure to perform an act when it is a duty to do so constitutes a criminal offence. Failure to provide the necessaries of life is one such offence. Section 215 of the Criminal Code typically is engaged when persons in care of another, such as a parent, foster parent, guardian or head of a family, are alleged not to have provided a person under their supervision with the necessaries of life. Recent cases have considered this provision in relation to adult children falling short of looking after their ailing or inform parents. The ambit of s.215 in such cases is discussed. Strategies for developing a family plan to care for elderly parents and resolving differences of opinion as to care is discussed by a therapist.
